Earthjustice fights tirelessly in our courts to preserve the right to breathe clean air, drink clean water and enjoy wild places and wildlife. Our attorneys have seen firsthand how often these rights can come down to a single vote by one of the nine justices on the U.S. Supreme Court.

Tell your senators that it’s not in America’s best interest to put politics above people by obstructing a Supreme Court nominee.

As the nation’s premier nonprofit environmental law organization, Earthjustice knows the value of our legal system and judicial nominations.

A landmark Supreme Court ruling in 2007 made it clear that the greenhouse gas pollution driving climate change must be controlled under the Clean Air Act. In contrast, a muddled 2006 Supreme Court ruling on the Clean Water Act left the protection of drinking water sources for over 130 million Americans in limbo.

But now, facing a new vacancy on the Supreme Court, Senate Majority Leader Mitch McConnell (R-KY) and Senate Judiciary Chairman Charles Grassley (R-IA) have thrown down the gauntlet, refusing to grant a hearing to anyone the president nominates, regardless of qualifications. McConnell and Grassley hope to keep the Supreme Court seat vacant until after a new president is inaugurated next year. Never in history has a Senate majority leader said that he or she would refuse to consider or vote on anyone nominated by a current president.

The Constitution clearly states that it is the president’s responsibility to nominate a new justice when there’s a vacancy, with no exception for election years. Senators need to do their jobs rather than play political games and delay action on this necessary nomination to our highest court.

Urge your senators to do their job and support an up or down vote on whoever is nominated for the Supreme Court.
